    My former Landlord owes me a significant amount of Money So I have a claim against this Person. When I mentioned it to them they told me to contact their lawyer. When I contacted their Lawyer the lawyer's office would not let me talk to the lawyer. So I contacted the Landlord via E-mail asking that they tell their lawyer to discuss this matter with me or my representatives. A few weeks later I get a voice mail from someone who says they are the police and that I am being charged with aggrevated harassment. From my research AH refers to making threats to cause harm or danger to someone. I have sent them 2 e-mails in 2 months reguarding this matter. First was a itemized list of my complaints and a change to avoid court and lawyers the Second was an e-mail informing them that I attempted to contact their lawyer and the Lawyer would not take my call. I asked them to have their lawyer call me.

    Sounds like they are just trying to scare you... I don't think the police would leave you such a voicemail...

    i don't think you'd get charged with anything over the phone. they have to give you something in writing.

    the charge is bogus.

    if you are actually being investigated or will be charged, you'll see cops at your house with badges. you'll be formally cited into court -- served with legal paperwork.

    since none of these have actually happened, I suspect someone connected with "this person" made false phone call claiming to be police, etc.

    if you can still access this voice mail, take it to the actual police and file a harassment complaint for real. then tell story. probably nothing will happen and police get irritated when someone impersonates them illegally.

    then have your lawyer file suit against "that person" for the money -- they're stalling or trying to scare you off completely.

    A. The police will not call you and tell you that you're being charged with harrassment. They'll simply show up for your arrest. So that's someone pretending to be the police, which technically is probably a violation on their part.

    B. 'Aggravated' refers to a charge in which bodily harm, or threat of such, is included in the act. There is no such thing as 'aggravated harrassment'. As for continual 'harrassment', the law is specific about what constitutes harrassment and it's a LOT more than simply calling someone for an appointment every other day.

    C. His lawyer has no obligation to grant you an interview or conference. It appears that the only thing he will recognize is an actual summons to appear in court. Your option is to hire an attorney to pursue a lawsuit or, if the amount is small enough (usually under $5,000) you can file a claim in Small Claims Court (usually a $25 - $50 fee). You won't need an attorney, but you will need all your ducks in a row to substantiate your case. You need pictures, documentation, or something that YOU have not generated that convinces the judge of your claim. Your landlord, on the other hand, can't just say he doesn't owe it. He also needs proof, in the form of documentation that he has not created, that convinces a judge that he is not liable. You, being the plaintiff, do carry the burden of proof, however, to make your case.
